Liability & Responsibility

• Participants shall assume full liability and responsibility in case of any liability, mishap, injury, damage, claim or accidents (including death) resulting from their participation in this Challenge, redemption and/or utilisation of the prizes. The Organiser shall not be responsible for any liability, mishap, loss, damage, claim or accident (including death) in any manner whatsoever.
• All recording, transportation, accommodation, personal costs and/or any other costs, fees and/or other expenses that are incurred to participate in this Chal-lenge and to redeem the prize is the sole responsibility of the winner unless it is specified otherwise by the Organiser.
• The Organiser shall not be responsible for any error, omission, interruption, de-letion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorised access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical prob-lems or traffic congestion on the Internet and/or websites.

Privacy Notice

• By participating in the Challenge, the Participants consent for the Organiser and any of its holding, subsidiary or related companies as defined in the Companies Act 1965 and its service providers, agents and contractors who provide adminis-trative and business support to the Organiser and act on the Organiser’s behalf (“Authorised Third Parties”) (Collectively “the Organiser”) to collect, process, safekeep the required details and to disclose the Participants’ personal details to the related parties involved in organising the Challenge, in accordance with the Personal Data Protection Act 2010 for purposes of the Challenge.
• In the event that Participants wish to revoke their consent, such revocation must be made in writing and received by the Organiser before the expiry of the Chal-lenge Period. By revoking consent, Participants are deemed to have withdrawn from the Challenge and may not be eligible to advance in the Challenge and/or win any prizes. Participants who revoke their consent after winning will forfeit all prizes and the Organiser will not be responsible, or held accountable to re-imburse Participants for the forfeiture of the prizes.
• The Organiser may also use the Participants’ personal information for purposes of contacting and sending to the Participants marketing and promotional infor-mation or materials about the Organiser’s products, services, any promotions, events or competitions organised by the Organiser.
• In respect of minors or individuals not legally competent to give consent, the Participants confirm that they have appointed the parent or guardian to consent on their behalf to the processing of their personal information in accordance with this privacy notice.
• At times the Organiser may retain Authorised Third Parties to process the Participants’ personal information. All such Authorised Third Parties are contrac-tually bound to take reasonable measures to keep information secure and not to use the Participants’ personal information in any way other than that which is specified here and in the Organiser’s privacy policy at https://www.faber-castell.com.my/legal/data-privacy.
• The Organiser is a multinational company and the Participants’ personal infor-mation may be transferred across borders. The Organiser will ensure that the country the Participants’ data is transferred to has a similar or equivalent per-sonal information protection laws in place, as set out in the Organiser’s privacy policy at https://www.faber-castell.com.my/legal/data-privacy.
• To the extent that the applicable law permits, Participants have the right to re-quest for access to, request for a copy of, request to update or correct the Partic-ipants’ personal information held by the Organiser.

Additional Terms and Conditions

• By participating in the Competition, Participants acknowledge to have read, under-stood and agreed to be bound by the Terms and Conditions of the Competition, and the decisions of the Organiser.
• Any images or pictures used in promoting the Challenge are purely for illustration purposes only.
• The Challenge is in no way sponsored, endorsed or administered by, or associated with, Facebook.
• Any matter with regards to the Challenge which is not covered in this Challenge T&Cs will be determined by the Organiser at its sole discretion.
